By accessing or using KESS, a product of Peppercake ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.
2. Description of Service
KESS is a subscription-based salon booking and management system that enables salon owners to manage appointments, customer communications, and business operations online. We offer three subscription tiers:
- Kess Lite - $35/month
- Kess Pro - $65/month
- Kess Premium - $105/month
3. Account Registration
To use KESS, you must:
- Be at least 18 years old
- Provide accurate, current, and complete information
- Maintain and update your account information
- Maintain the security of your password
- Accept responsibility for all activities under your account
4. Free Trial
We offer a 30-day free trial for all plans. No credit card is required to start your trial. At the end of the trial period, you must subscribe to a paid plan to continue using KESS. You may cancel at any time during the trial period without charge.
5. Subscription and Payment
5.1 Billing
Subscriptions are billed monthly in advance. Payment must be made by credit card or other approved payment method. All fees are in USD and non-refundable except as required by law.
5.2 Automatic Renewal
Your subscription will automatically renew each month unless you cancel before the renewal date. We will charge your payment method on file at the start of each billing cycle.
5.3 Price Changes
We reserve the right to change our pricing with 30 days' notice. Price changes will not affect your current billing cycle but will apply to subsequent renewals.
5.4 Cancellation
You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period. No refunds will be provided for partial months.
6. Usage Limits
Each subscription plan includes specific limits on bookings, locations, and staff members. Exceeding these limits may result in additional charges or service restrictions. Custom packages are available for businesses requiring higher limits.
7. Acceptable Use
You agree not to:
- Use KESS for any illegal purpose
- Violate any laws or regulations
- Infringe on intellectual property rights
- Transmit malicious code or viruses
- Attempt to gain unauthorized access to our systems
- Interfere with other users' access to KESS
- Use KESS to spam or harass others
- Resell or redistribute KESS services
8. Intellectual Property
KESS and all related content, features, and functionality are owned by Peppercake and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use KESS for its intended purpose.
9. Your Content
You retain ownership of all content you upload to KESS (including salon information, logos, and customer data). By using KESS, you grant us a license to use, store, and display your content solely to provide our services to you.
10. Data and Privacy
Your use of KESS is also governed by our Privacy Policy. We are committed to protecting your data and complying with applicable data protection laws.
11. Service Availability
While we strive for 99.9% uptime, we do not guarantee uninterrupted access to KESS. We may perform maintenance, updates, or modifications that temporarily affect service availability. We will provide advance notice when possible.
12. Termination
We reserve the right to suspend or terminate your account if you:
- Violate these Terms
- Fail to pay subscription fees
- Engage in fraudulent activity
- Use KESS in a manner that harms our business or other users
13. Disclaimers
KESS is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:
- KESS will meet your specific requirements
- KESS will be uninterrupted, timely, or error-free
- Results obtained from KESS will be accurate or reliable
- Any defects will be corrected
14. Limitation of Liability
To the maximum extent permitted by law, Peppercake shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities arising from your use of KESS.
15. Indemnification
You agree to indemnify and hold harmless Peppercake and its affiliates from any claims, damages, losses, or expenses arising from your use of KESS or violation of these Terms.
16. Modifications to Terms
We may modify these Terms at any time. We will notify you of material changes via email or through KESS. Your continued use after changes constitutes acceptance of the modified Terms.
